1. ACCEPTANCE OF TERMS
By accessing or using Starzone.in ("Website", "we", "our", "us"), you agree to be legally bound by these Terms and Conditions. If you do not agree, do not use our website. Your continued use constitutes acceptance of any future changes.
2. ELIGIBILITY
You confirm that you are at least 18 years old. If you are under 18, you may only use this website under the supervision of a parent or legal guardian who agrees to be bound by these Terms.
3. NATURE OF SERVICES
Starzone.in provides social media marketing (SMM) services including but not limited to followers, likes, views, comments, and other engagement metrics on third-party platforms (Instagram, YouTube, Facebook, TikTok, Twitter, Telegram, etc.). All services are digital, automated, and non-unique.
4. ABSOLUTE PROHIBITION – ZERO TOLERANCE POLICY
Starzone.in has a STRICT ZERO TOLERANCE policy. We DO NOT support, promote, or entertain ANY of the following:
❌ Fraud or Scam – Including fake giveaways, phishing, Ponzi schemes, impersonation, fake investment plans, or any deceptive practice.
❌ Gambling – Including casinos, betting, lottery, poker, rummy for real money, sports betting, or any gambling-related promotion.
❌ Illegal Activities – Including drug trafficking, weapons sale, human trafficking, hacking services, stolen credit cards, counterfeit goods, or any violation of Indian law.
❌ Terrorism & Extremism – Including support for terrorist organizations, hate speech, threats to national security, or inciting violence.
❌ Adult Content – Including pornography, OnlyFans, nude content, intimate images without consent, or any sexually explicit material.
❌ Hate Speech – Including racism, casteism, religious hatred, gender violence, or discrimination against any community.
🚨 VIOLATION CONSEQUENCES:
- Permanent account ban (no appeal)
- No refund of any remaining balance
- IP address, email, and transaction details reported to Indian Cyber Crime Cell
- Legal action may be pursued at our discretion
5. USER RESPONSIBILITY & INDEMNIFICATION
You are SOLELY responsible for:
- The content of the social media accounts you use with our services
- Ensuring your use of our services does not violate any third-party platform's terms of service (Instagram, YouTube, etc.)
- Obtaining any necessary consents for content you promote
You agree to INDEMNIFY AND HOLD HARMLESS Starzone.in, its owners, employees, and affiliates from any claims, damages, losses, or expenses (including legal fees) arising from your use of our services or violation of these Terms.
6. DISCLAIMER OF WARRANTIES
TO THE MAXIMUM EXTENT PERMITTED BY LAW:
Starzone.in provides services "AS IS" and "AS AVAILABLE" without any warranties of any kind, either express or implied.
We do NOT guarantee:
- That our services will be 100% compatible with third-party platform updates
- That your social media account will not be banned, shadowbanned, or restricted
- Any specific results, including viral growth or revenue generation
- That services will be uninterrupted or error-free
THIRD-PARTY PLATFORMS (Instagram, YouTube, Facebook, etc.) explicitly prohibit buying followers or engagement. You use our services at YOUR OWN RISK. Starzone.in is NOT responsible if your account gets banned by any third-party platform.
7. LIMITATION OF LIABILITY
UNDER NO CIRCUMSTANCES shall Starzone.in, its directors, employees, or agents be liable for:
- Any indirect, incidental, special, consequential, or punitive damages
- Loss of profits, revenue, data, or business opportunities
- Damages arising from third-party platform account bans or restrictions
Our TOTAL LIABILITY to you shall not exceed the amount you actually paid to us in the 90 days preceding any claim. This limitation applies regardless of the legal theory (contract, tort, negligence, etc.).
8. PAYMENTS, REFUNDS & CANCELLATIONS
- All payments are processed through secure third-party gateways. We do not store your payment details.
- Once an order status shows "Processing" or "Completed", NO REFUND will be issued because services are digital and delivered instantly.
- Unused wallet balance: Refundable subject to a 15% processing fee + any applicable GST.
- Refill guarantee: 30 days from order date. If engagement drops more than 10% due to platform cleaning, we will refill once.
- No refund or refill for deleted social media accounts, private accounts, or fan pages.
- Chargebacks: If you file an unjustified chargeback, your account will be permanently banned, and we reserve the right to pursue legal action.
9. INTELLECTUAL PROPERTY
All content on Starzone.in (including text, graphics, logos, images, and software) is our property or licensed to us. You may not copy, modify, distribute, or reverse-engineer any part of our website without written permission.
10. THIRD-PARTY LINKS & SERVICES
Our website may contain links to third-party websites or services. We are NOT responsible for their content, privacy policies, or practices. You access them at your own risk.
11. FORCE MAJEURE
We shall not be liable for any delay or failure to perform resulting from causes outside our reasonable control, including but not limited to natural disasters, war, terrorism, riots, government orders, internet outages, or third-party platform changes.
12. GOVERNING LAW & JURISDICTION
These Terms shall be governed by and construed in accordance with the laws of INDIA. Any dispute arising from or relating to these Terms or your use of our website shall be subject to the EXCLUSIVE JURISDICTION of the courts in Kolkata, India.
13. DISPUTE RESOLUTION (ARBITRATION)
Any dispute, claim, or controversy arising out of these Terms shall first be attempted to be resolved through good-faith negotiation within 30 days. If unresolved, the dispute shall be referred to binding arbitration under the Arbitration and Conciliation Act, 1996, conducted by a sole arbitrator mutually agreed upon. The arbitration shall be held in [Kolkata], and the language shall be English. The arbitrator's decision shall be final and binding.
14. SEVERABILITY
If any provision of these Terms is found to be unenforceable or invalid, that provision shall be limited or eliminated to the minimum extent necessary, and the remaining provisions shall remain in full force and effect.
15. NO WAIVER
Our failure to enforce any right or provision of these Terms shall not constitute a waiver of such right or provision.
16. ENTIRE AGREEMENT
These Terms constitute the entire agreement between you and Starzone.in regarding your use of our website and supersede all prior agreements.
